1. Title and scope
These Payment & Subscription Terms ("Payment Terms") govern the optional paid subscription offered within the NearBuddy mobile application and described on the NearBuddy website. They apply in addition to, and form part of, the NearBuddy Terms & Conditions, and are to be read together with the NearBuddy Privacy Policy. Where these Payment Terms and the general Terms & Conditions address the same payment or subscription matter, these Payment Terms govern that matter.
2. Acceptance of these Payment & Subscription Terms
By purchasing, renewing, or using a NearBuddy subscription, you agree to these Payment Terms. If you do not agree, do not purchase a subscription. Your eligibility to use NearBuddy is set out in the NearBuddy Terms & Conditions.
3. Effective Date and first-store launch rule
"Effective Date" means the date and time on which the NearBuddy Ad-Free Subscription first becomes publicly available for purchase through either Google Play or the Apple App Store, whichever occurs first.
From the Effective Date, all payment, subscription, billing, renewal, entitlement, cancellation, refund, and related conditions in these Payment Terms apply. If the NearBuddy Ad-Free Subscription later becomes available on the second store, that later launch does not create a new Effective Date; these Payment Terms continue in force from the first-store launch. The store-specific provisions (Sections 23 and 24) apply to you according to the store through which you make your purchase. These Payment Terms remain in force from the first-store launch unless and until they are revised in accordance with Sections 18 and 29.
4. The Ad-Free Subscription product
NearBuddy is free to download and use. NearBuddy also offers an optional paid subscription known as the Ad-Free Subscription. "Ad-Free Subscription" is the name of this subscription product. The Ad-Free Subscription is purchased through, and billed by, the applicable app store, as described in these Payment Terms.
5. Subscription durations
The Ad-Free Subscription is offered in the following durations:
- 1 month
- 3 months
- 6 months
- 1 year
The durations available to you are shown in the app and on the applicable store purchase screen at the time of purchase.
6. Benefits shown at purchase
The benefits included in the Ad-Free Subscription are the benefits shown to you in the NearBuddy app and in the applicable store's purchase presentation at the time of purchase. Those displayed benefits form part of the subscription offer for the duration you buy. Before purchasing, you should review the benefits shown at that time so that you understand what your subscription includes. Any change to the benefits will be handled consistently with these Payment Terms (Section 18), the applicable store's requirements, and applicable law.
7. Store-authoritative prices and taxes
The current price of each subscription, the billing period, any applicable taxes, and a purchase confirmation are shown to you by the applicable app store on the purchase screen at the time of purchase. The price shown by the app store at the time of purchase is the price that applies to you. Prices may vary by country and region and over time, and are presented in your local currency where the app store supports it.
8. Purchase processing
Subscriptions are purchased and billed through the applicable app store — Google Play Billing on Android or Apple In-App Purchase on iOS — under that store's terms. Your purchase is completed within the app store, and the app store is responsible for charging you and confirming the transaction.
9. RevenueCat's role
NearBuddy uses RevenueCat, a subscription-management service, to verify and process subscription-entitlement information — for example, to confirm that a valid subscription exists and to keep your access accurate. RevenueCat processes the entitlement and transaction information needed for this purpose on NearBuddy's behalf.
10. Auto-renewal
The Ad-Free Subscription is auto-renewing. Unless you cancel it, it automatically renews at the end of each subscription period, and the applicable app store charges you for the next period using your chosen payment method, at the price then shown by the app store.
11. Billing and renewal
Billing, renewal timing, and the charging of your payment method are handled by the applicable app store. Each renewal is for the same duration as the subscription you purchased, unless you change or cancel it through the store, and is charged at or around the start of each new period in accordance with the store's process.
12. Managing and cancelling your subscription
You can view, manage, or cancel your subscription at any time through your account settings in the applicable app store:
- On Android, through your Google Play account subscriptions.
- On iOS, through your Apple account subscriptions.
To avoid being charged for the next period, cancel before the current period's renewal date, as the applicable store requires. Cancellation takes effect according to the store's process.
13. Access after cancellation
If you cancel, your cancellation stops future renewals. Your paid Ad-Free access continues until the verified end of the period you have already paid for, and then ends. Access may end earlier if the app store revokes or refunds the purchase, or where applicable law requires otherwise.
14. Payment issues, grace period, suspension, expiry, and restoration of access
Your Ad-Free access depends on a valid, active subscription as confirmed by the applicable app store. The following describes, in general terms, how your access behaves:
- Payment retry and grace period. If a renewal payment cannot be completed at first, the applicable store may retry the charge for a period. During such a grace period, your Ad-Free access may continue while the store attempts to collect payment.
- On-hold and suspension. If the payment issue is not resolved, your subscription may be placed on hold and your Ad-Free access may be suspended until the payment issue is resolved.
- Pause. Where the applicable store supports pausing a subscription and you pause it, your Ad-Free access is suspended until you resume the subscription.
- Expiry. When a subscription period ends without renewal, or the subscription otherwise expires or ends, your Ad-Free access ends.
- Restoration of access. If a payment issue is resolved, or you resume a paused subscription, your Ad-Free access is restored in line with your renewed or continued subscription. This restoration of subscription access following a resolved billing event is separate from account recovery; NearBuddy does not provide account recovery or entitlement restoration to a different account (see Sections 16 and 17).
15. Refunds, reversals, and revoked purchases
Purchases are made through the app store, and refunds and cancellations of charges are controlled by Google Play or Apple under their applicable policies and applicable law. Refund requests are submitted to, and decided by, the applicable app store. NearBuddy does not itself issue app-store subscription refunds and does not control the app store's refund decisions.
If a purchase is refunded, reversed, or otherwise revoked by the app store, the Ad-Free access associated with that purchase is removed, and this may take effect immediately.
Nothing in these Payment Terms limits any right you may have under applicable law that cannot be excluded.
16. Account-bound and non-transferable entitlement
Your NearBuddy account is anonymous, and NearBuddy does not use an email address, phone number, or password to sign you in. A subscription and its benefits are bound to the specific anonymous NearBuddy account associated with the verified purchase. Your subscription entitlement is not transferable to any other account.
17. Lost anonymous accounts and no restoration
Because your account is anonymous, if your account is lost, deleted, inaccessible, or otherwise cannot be accessed, NearBuddy does not provide any recovery, rebinding, migration, transfer, or historical restoration of the subscription entitlement to a new or different account, and does not provide a replacement or reimbursement for it. Please keep this in mind before purchasing, and manage your device and account access accordingly. How your account and data are handled is described further in the Privacy Policy and the Terms & Conditions.
18. Changes to plans, prices, or benefits
NearBuddy may change the subscription plans, the durations offered, the benefits included in the Ad-Free Subscription, or the prices. Where the applicable app store requires, you will be notified in advance of a price change and given the opportunity to cancel before the change takes effect. Changes are applied consistently with these Payment Terms, the applicable store's requirements, and applicable law. Continuing your subscription after a change takes effect means the change applies to you.
19. Availability and technical interruptions
Subscription features depend on the app, the app stores, and third-party services, and may be unavailable or interrupted at times, including for maintenance, technical issues, or reasons outside our control. We do not guarantee that subscription features will be available without interruption or error.
20. Prohibited payment or purchase abuse
You must not misuse the purchase and subscription features. In particular, you must not attempt to obtain or extend subscription benefits through fraudulent, unauthorised, or manipulated purchases; abuse refunds or chargebacks; or attempt to circumvent the app store's or NearBuddy's purchase and entitlement safeguards. We may suspend or remove access obtained in this way, as set out in the Terms & Conditions.
21. Relationship with the Privacy Policy
The handling of your personal information, including subscription-status information, is described in the NearBuddy Privacy Policy, available on the NearBuddy website. NearBuddy does not collect, receive, or store your payment-card or bank-account details; your payment method and payment details are handled entirely by the applicable app store under its own terms and privacy policy. NearBuddy receives only the subscription-entitlement information needed to provide and maintain your access.
22. Relationship with the general Terms & Conditions
These Payment Terms form part of your agreement with NearBuddy and are to be read together with the NearBuddy Terms & Conditions and the NearBuddy Privacy Policy, each available on the NearBuddy website. Where these Payment Terms address a payment or subscription matter, they take precedence over any more general statement in the Terms & Conditions on that matter.
23. Apple App Store terms
If you purchase through the Apple App Store, the following also applies, as required by Apple: these Payment Terms are between you and NAMAVI TECHNOLOGIES PRIVATE LIMITED only, and not with Apple; Apple is not responsible for the app or its content or for any subscription, and is not responsible for any support or any claims relating to the subscription; and Apple and its subsidiaries are third-party beneficiaries of these Payment Terms and may enforce them against you. Your purchase through the Apple App Store is also subject to Apple's applicable terms.
24. Google Play terms
If you purchase on Android through Google Play, your purchase is processed through Google Play Billing and is subject to Google Play's applicable terms; billing, renewals, cancellations, and refunds are handled through Google Play.

Questions about a specific charge, a refund, or your payment method may need to be directed to the applicable app store, which processes payments and controls refunds.
26. Governing law
These Payment Terms shall be governed by the laws of India.
27. Dispute resolution
The parties shall first make a good-faith effort to resolve any dispute amicably.
28. Jurisdiction
If a dispute cannot be resolved amicably, it shall be subject to the exclusive jurisdiction of the courts at Thrissur, Kerala, India.
29. Last Updated
The "Last Updated" date of these Payment Terms is the Effective Date for this initial version. If these Payment Terms are later revised, the "Last Updated" date becomes the date of that revision. The Effective Date as defined in Section 3 continues to apply to the original Terms unless a revision expressly states otherwise.
