1. Purpose and scope

This Refund & Cancellation Policy ("Policy") explains how cancellation and refunds work for the optional paid Ad-Free Subscription offered within the NearBuddy mobile application and described on the NearBuddy website. It applies to subscriptions purchased through the applicable app store and should be read together with the NearBuddy Payment & Subscription Terms, the NearBuddy Terms & Conditions, and the NearBuddy Privacy Policy.

2. Acceptance and relationship to the general Terms

By purchasing, renewing, or using a NearBuddy subscription, you agree to this Policy. This Policy forms part of your agreement with NearBuddy and supplements the NearBuddy Payment & Subscription Terms and the NearBuddy Terms & Conditions. Where this Policy and the general Terms & Conditions address the same refund or cancellation matter, this Policy and the Payment & Subscription Terms govern that matter.

3. Effective Date and first-store-live rule

"Effective Date" means the date and time on which the NearBuddy Ad-Free Subscription first becomes publicly available for purchase through either Google Play or the Apple App Store, whichever occurs first.

From the Effective Date, all refund, cancellation, renewal, entitlement, revocation, payment-failure, and related conditions in this Policy apply. If the NearBuddy Ad-Free Subscription later becomes available on the second store, that later launch does not create or reset the Effective Date; this Policy continues in force from the first-store launch. The store-specific provisions (Sections 19 and 20) apply to you according to the store through which you made your purchase. This Policy remains in force from the first-store launch unless and until it is revised in accordance with Section 27.

4. Store-based purchases

Subscriptions are purchased and billed through the applicable app store — Google Play Billing on Android or Apple In-App Purchase on iOS — under that store's terms. NearBuddy uses RevenueCat to verify and process subscription-entitlement information, so that your access reflects your subscription status. Your purchase is completed within the app store, and the app store is responsible for charging you and confirming the transaction.

5. Auto-renewal

The Ad-Free Subscription is auto-renewing. Unless you cancel it, it automatically renews at the end of each subscription period, and the applicable app store charges you for the next period at the price then shown by the app store.

6. How to cancel

You can cancel your subscription at any time through your account settings in the applicable app store:

  • On Android, through your Google Play account subscriptions.
  • On iOS, through your Apple account subscriptions.

To avoid being charged for the next period, cancel before the current period's renewal date, as the applicable store requires. Cancellation takes effect according to the store's process.

7. Effect of cancellation

Cancelling stops future auto-renewals so that your subscription is not charged again for a new period. Cancellation by itself does not remove your Ad-Free access during a period you have already paid for, and cancelling does not, by itself, produce a refund.

8. Access until the end of the paid period

When you cancel auto-renewal and your already-paid period has not yet ended, your Ad-Free access remains active until the verified end of that paid period, and then ends. The app clearly shows that your Ad-Free access remains active until that expiry date. Your access may end earlier only if the app store revokes or refunds the purchase, or where applicable law requires otherwise.

9. Payment failure and grace period

If a renewal payment cannot be completed, the applicable app store may retry the charge for a period known as a grace period. During a verified grace period, your Ad-Free benefits continue. In this situation the app shows a payment-issue message, but it does not switch off your Ad-Free access, and it provides a Manage Subscription action that opens the relevant Google Play or Apple subscription-management page so you can update your payment details.

10. On-hold, suspended, paused, expired, and revoked states

If a payment issue is not resolved by the end of the verified grace period, your subscription may move into an on-hold or suspended state. When this happens, your Ad-Free access turns off immediately. During an on-hold or suspended state, the app shows a payment-issue message and provides a Manage Subscription action that opens the relevant store subscription-management page.

Where the applicable store supports pausing a subscription and you pause it, your Ad-Free access is suspended until you resume the subscription. When a subscription period ends without renewal, or the subscription otherwise expires, is canceled and has passed its paid period, or is revoked, your Ad-Free access ends.

11. Payment recovery and restoration of Ad-Free access

If the applicable store later verifies that your payment has been recovered — or you resume a paused subscription — your Ad-Free access is restored automatically, in line with your renewed or continued subscription.

This restoration applies to your subscription access only. It is not account recovery: recovering a payment does not recover, transfer, rebind, migrate, or restore a NearBuddy account that has been lost or become inaccessible (see Sections 17 and 18).

12. Refund requests

Because purchases are made and billed through the app store, any refund request must be made to, and is handled by, the applicable app store (Google Play or Apple), under that store's policies and applicable law.

13. Store-controlled refund decisions

Refunds and refund decisions are controlled by Google Play or Apple. Whether a refund is granted, and on what terms, is determined by the applicable store under its policies and applicable law. NearBuddy does not control or decide the app store's refund outcomes.

14. Effect of a refund or revocation on entitlement

If a purchase is refunded, reversed, or otherwise revoked by the app store, the Ad-Free access associated with that purchase is removed, and this may take effect immediately.

15. No direct refund processing by NearBuddy

NearBuddy does not itself issue app-store subscription refunds and does not guarantee any refund. NearBuddy reflects the app store's verified refund or revocation by adjusting your access accordingly, as described in Section 14.

16. No card or bank data collected by NearBuddy

NearBuddy does not collect, receive, or store your payment-card or bank-account details. Your payment method and payment details are handled entirely by the applicable app store under its own terms and privacy policy. NearBuddy receives only the subscription-entitlement information needed to provide and maintain your access.

17. Account-bound and non-transferable entitlement

Your NearBuddy account is anonymous, and NearBuddy does not use an email address, phone number, or password to sign you in. A subscription and its benefits are bound to the specific anonymous NearBuddy account associated with the verified purchase. Your subscription entitlement is not transferable to any other account.

18. Lost anonymous accounts and no restoration

Because your account is anonymous, if your account is lost, deleted, inaccessible, or otherwise cannot be accessed, NearBuddy does not provide any recovery, transfer, rebinding, migration, or historical restoration of the subscription entitlement to a new or different account, and does not provide a replacement or reimbursement for it. Please keep this in mind before purchasing, and manage your device and account access accordingly.

19. Store-specific provisions for Google Play

If you purchase on Android through Google Play, your purchase, billing, renewals, cancellations, and refunds are processed and handled through Google Play under Google Play's applicable terms and policies.

20. Store-specific provisions for Apple

If you purchase through the Apple App Store, your purchase, billing, renewals, cancellations, and refunds are processed and handled through Apple under Apple's applicable terms and policies. Where required by Apple: this Policy is between you and NAMAVI TECHNOLOGIES PRIVATE LIMITED only, and not with Apple; Apple is not responsible for the app, its content, or any subscription, or for any related support or claims; and Apple and its subsidiaries are third-party beneficiaries of this Policy and may enforce it against you.

Please note that a request for a refund, or a question about a specific charge or your payment method, must be directed to the applicable app store, which processes payments and controls refunds.

22. Relationship with the Privacy Policy

How your personal information, including subscription-status information, is handled is described in the NearBuddy Privacy Policy, available on the NearBuddy website.

23. Relationship with the Payment & Subscription Terms

This Policy supplements the NearBuddy Payment & Subscription Terms, which describe the subscription, its durations, pricing, auto-renewal, and entitlement in more detail. This Policy and the Payment & Subscription Terms are to be read together; where they address the same refund or cancellation matter, they are intended to be consistent.

24. Governing law

This Policy shall be governed by the laws of India.

25. Dispute resolution

The parties shall first make a good-faith effort to resolve any dispute amicably.

26. Jurisdiction

If a dispute cannot be resolved amicably, it shall be subject to the exclusive jurisdiction of the courts at Thrissur, Kerala, India.

27. Last Updated

The "Last Updated" date of this Policy is the Effective Date for this initial version. If this Policy is later revised, the "Last Updated" date becomes the date of that revision. The Effective Date as defined in Section 3 continues to apply to the original Policy unless a revision expressly states otherwise.

Nothing in this Policy limits any right or remedy you may have under applicable law that cannot be excluded.
