1. About these Terms and your acceptance
These Terms & Conditions ("Terms") are a legal agreement between you and NAMAVI TECHNOLOGIES PRIVATE LIMITED ("NearBuddy", "the Company", "we", "us", "our") governing your use of the NearBuddy mobile application and the NearBuddy website at https://near-buddy.com (together, the "Services").
By creating a NearBuddy account, or by accessing or using the Services, you agree to these Terms and to our Privacy Policy, which is incorporated into these Terms by reference. When you first set up NearBuddy, you are asked to accept these Terms and the Privacy Policy before you can continue; if you do not agree, do not use the Services.
2. Definitions
- Services — the NearBuddy mobile app and the NearBuddy website.
- Account — the anonymous account created for you when you set up NearBuddy.
- User Content — the information and materials you add or send through the Services, such as your profile details, photos, and messages.
- Ad-Free Subscription — the optional paid subscription described in Section 9.
- App Store — Google Play or the Apple App Store, through which you may obtain the app and, where offered, purchase the Ad-Free Subscription.
3. Eligibility
NearBuddy is only for adults. You must be at least 18 years old to create an account or use the Services, and by using NearBuddy you confirm that you are 18 or older. NearBuddy is not intended for, and may not be used by, anyone under 18. Age is self-declared during sign-up; if we learn that a user is under 18, we may remove the account.
4. Your NearBuddy account
Your NearBuddy account is anonymous. NearBuddy does not use, and does not ask you for, an email address, phone number, real name, password, one-time passcode, or any government ID to create or use an account. Your session keeps you signed in on your device.
Because accounts are anonymous, there is no password recovery and no account recovery or restoration. If you lose access to your account — for example, by uninstalling the app, clearing app data, or changing devices — that account cannot be recovered or restored, and using NearBuddy again creates a new, separate account. You are responsible for the activity that takes place through your account on your device.
5. Acceptable use
You agree to use NearBuddy lawfully, respectfully, and only for its intended purpose of meeting people. You agree not to:
- provide false, misleading, or impersonating profile information, or pretend to be someone you are not;
- harass, threaten, abuse, stalk, bully, or intimidate any person;
- post or send content that is unlawful, hateful, sexually exploitative, obscene, violent, or otherwise harmful;
- upload photos that are not of you, that you do not have the right to use, or that violate another person's rights;
- solicit money, engage in scams or fraud, or use the Services for any commercial or promotional purpose without our permission;
- attempt to obtain other users' personal information, or use the Services to harm or exploit others;
- interfere with, disrupt, probe, or attempt to gain unauthorised access to the Services, our systems, or other users' accounts;
- use bots, scrapers, or other automated means to access the Services, or attempt to circumvent any limits or safeguards;
- use the Services in violation of any applicable law.
You are solely responsible for your interactions with other users and for the content you provide.
6. User Content and licence
You keep ownership of your User Content. You are responsible for it and confirm that you have the rights to share it and that it does not break these Terms or any law.
To operate the Services, you grant NearBuddy a non-exclusive, worldwide, royalty-free licence to host, store, process, and display your User Content solely to provide the Services to you and other users — for example, to show your profile and photos to potential matches and to deliver your messages to the people you are matched with. This licence exists only so that NearBuddy can run the features you use; we do not use your User Content for advertising, and we do not sell it.
Your User Content is kept while your account exists and is removed when you delete your account, as described in Section 11, in our Privacy Policy, and in the NearBuddy Account Deletion Policy.
7. Safety, blocking, and reporting
NearBuddy provides tools to help keep the community safe:
- Block — you can block another user; you will no longer see each other. Blocking is permanent.
- Report — you can report a profile, including a suspected underage user. Reports are recorded so that they can be reviewed. The person you report is not told that you reported them.
To be clear and honest about how this works: NearBuddy does not actively monitor, scan, or moderate the content of profiles or messages, and reporting a user does not by itself remove that user. You should use good judgement, protect your personal information, and take normal safety precautions when interacting with or meeting other people. NearBuddy is not responsible for the conduct of any user.
8. The matching service
NearBuddy shows you other users near you based on your preferences and settings, and calculates an approximate distance between users. Your exact location is never shared with other users — only an approximate distance is shown.
NearBuddy does not guarantee that you will receive any particular profiles, that anyone will like you back, that you will form any match, or that suitable people will be available in your area at any time. The Services are provided on an "as available" basis and depend on other users and on factors outside our control.
9. Ad-Free Subscription, billing, and refunds
NearBuddy is free to download and use. NearBuddy also offers an optional paid Ad-Free Subscription in different durations.
If you choose to subscribe:
- The purchase is made and billed through the App Store (Google Play or Apple), under that store's terms. The applicable price is the price shown by the App Store at the time of purchase.
- The subscription is auto-renewing: it continues, and the App Store charges you for each period, until you cancel. You manage, renew, or cancel your subscription in your Google Play or Apple account subscription settings.
- NearBuddy does not process payments and does not store your card or bank details. NearBuddy only records your subscription status and the purchase event needed to keep your benefit accurate.
- Refunds and cancellations are handled by the App Store, not by NearBuddy. NearBuddy does not issue refunds itself; any refund is subject to the App Store's policies and applicable law.
- A subscription and its benefit are tied to the account that made the purchase and cannot be transferred to another account. Because accounts are anonymous and cannot be recovered (Section 4), a subscription benefit cannot be restored to a new account if you lose access to the original one.
Nothing in this Section limits any rights you may have under applicable law that cannot be excluded.
10. Third-party services
NearBuddy relies on a limited set of service providers to operate, as described in the Privacy Policy — including the App Stores (Google Play and Apple), our subscription-verification provider (RevenueCat), and our backend provider (Supabase). Your use of an App Store, and any payment you make through it, is also governed by that store's own terms and privacy policy.
If you obtained NearBuddy from the Apple App Store, the following also applies, as required by Apple: these Terms are between you and NAMAVI TECHNOLOGIES PRIVATE LIMITED only, and not with Apple; Apple is not responsible for the app or its content, for any support or maintenance, or for any claims relating to the app; and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm that you are not located in a country subject to a relevant embargo and are not on a prohibited-parties list, and you will comply with applicable third-party terms when using the app.
11. Data, privacy, and retention
Our collection and use of your information is governed by the NearBuddy Privacy Policy, available on the NearBuddy website. Key points that also form part of your agreement with us:
- NearBuddy keeps your account, activity, message, and subscription data while your account exists, and retains only limited records after deletion, as described in the Privacy Policy and the NearBuddy Account Deletion Policy.
- You can permanently delete your account yourself, from within the app, using the Delete Account control while you are signed in. Deletion is immediate and permanent, and a deleted or lost anonymous account cannot be recovered. How your account and data are removed, and how an active paid benefit is handled, is described in the NearBuddy Account Deletion Policy. - NearBuddy's free experience is supported by advertising, which the optional Ad-Free Subscription removes; aside from advertising, NearBuddy does not use third-party analytics, crash-reporting SDKs, or push notifications, and does not sell your personal information.
In the event of any conflict between these Terms and the Privacy Policy about how your personal information is handled, the Privacy Policy governs that subject.
12. Suspension and termination
You may stop using NearBuddy at any time.
We reserve the right to suspend, restrict, or terminate your access to the Services, in whole or in part, if we reasonably believe you have violated these Terms or applicable law, or to protect the Services or other users. Where practical we will act proportionately, but we may act without prior notice where necessary. If your access is terminated, the licence in Section 6 ends for future use, and the data-handling and retention position described in Section 11 and the Privacy Policy continues to apply.
13. Disclaimers
The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, NearBuddy does not make warranties of any kind, whether express or implied, about the Services — including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement — and does not warrant that the Services will be uninterrupted, error-free, secure, or that any match, result, or outcome will be achieved.
NearBuddy does not conduct background checks on users and does not monitor or moderate user content or messages (Section 7). You are responsible for your own interactions, and you use the Services and interact with other users at your own risk. While we take reasonable measures to protect information (as described in the Privacy Policy), no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
Nothing in this Section removes or limits any warranty or right that cannot be excluded or limited under applicable law.
14. Limitation of liability
To the fullest extent permitted by applicable law, NearBuddy and NAMAVI TECHNOLOGIES PRIVATE LIMITED will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, goodwill, or opportunity, arising out of or relating to your use of (or inability to use) the Services or your interactions with other users.
Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including any liability that cannot be excluded under applicable law.
15. Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless NearBuddy and NAMAVI TECHNOLOGIES PRIVATE LIMITED from claims, damages, and reasonable costs arising out of your misuse of the Services, your User Content, or your breach of these Terms or of any law or the rights of another person.
16. Changes to the Services and to these Terms
NearBuddy is under active development, and we may add, change, or remove features, or suspend or discontinue parts of the Services. We may also update these Terms from time to time. When we make a material change to these Terms, we will update the "Last updated" date and, where appropriate, notify you or ask you to review and accept the updated Terms in the app. The current version of these Terms is always available on the NearBuddy website. Your continued use of the Services after an update means you accept the updated Terms.
17. Governing law, jurisdiction, and dispute resolution
These Terms shall be governed by the laws of India. The parties shall first make a good-faith effort to resolve any dispute amicably. If the dispute cannot be resolved, it shall be subject to the exclusive jurisdiction of the courts at Thrissur, Kerala, India.

19. General
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and NearBuddy about the Services and replace any earlier understanding on this subject.
- Severability. If any part of these Terms is found unenforceable, the rest remains in effect.
- No waiver. If we do not enforce a right at any time, that is not a waiver of that right.
- Assignment. You may not transfer your rights or obligations under these Terms. We may transfer ours to an affiliate or successor of the business.
